Judge dismisses state from Montgomery County data center lawsuit

COLUMBIA, Mo. (KMIZ)

A Cole County judge dismissed the state of Missouri as a defendant in a case over data centers in Montgomery County.

Defendants in a case filed in February – by a group Montgomery County residents and property owners called Preserve Montgomery County, LLC – filed a motion to dismiss the case earlier this month.

A judge on Monday allowed the Department of Economic Development to be removed as a defendant, but the case is still active against Montgomery County.

Previous reporting says plaintiffs claim the county has violated Missouri’s Sunshine Law in multiple ways, all connected to the approval of the data center.
