Lawsuit claims landlord wants to evict Raising Cane’s because restaurant “smells like chicken fingers”

    BOSTON (WBZ) — Raising Cane’s claims in a lawsuit that a Boston landlord has threatened to evict one of its locations in the Back Bay because the restaurant “smells like chicken fingers.”

The eatery opened on Boylston Street in 2022 in a 100-year-old building and had a lease through 2037. The lawsuit says the trouble started when the landlord began renting out office space on the second floor, and the tenants there complained of the “offensive odor.”

Raising Cane’s, which calls chicken fingers its “one love,” says it spent more than $200,000 to try and minimize the odor.

“Despite these efforts, Defendant continues to complain that its tenant’s chicken finger restaurant smells like chicken fingers,” the company said in its lawsuit. “In reality, it appears that Defendant has come to the realization that its own build-out of the second-floor office space was poorly executed.”

The lawsuit says that Raising Cane’s was informed last month that its lease would be terminated because of the “offensive and/or nuisance odors.”

The defendant is 775 Boylston LLC, which is affiliated with Heath Properties in Boston. Heath told WBZ-TV it has “no comment” on the lawsuit.

The lawsuit alleges that that the landlord tried to force Raising Cane’s to waive its right in the lease to be the “exclusive chicken restaurant” in the building. It says the landlord has been negotiating a lease with Panda Express to rent a spot right next to Raising Cane’s where a Starbucks used to be.

Panda Express has one other city location in the Boston University student union. Raising Cane’s also has a restaurant by the B.U. campus on Commonwealth Avenue, as well a location by Downtown Crossing.

His daughter’s quick thinking saved his life after a man shot him multiple times in front of his kids

COLORADO SPRINGS, Colo. (KRDO) – One man is sitting in the El Paso County jail, charged with shooting a local father in front of his children. 

The family says it was a senseless act of violence, but thanks to his children’s bravery, he was able to get the help he needed and is now recovering in the hospital.

KRDO13 spoke to his children, Alexas and Connor Rhinehart, who were sitting in the car when the shooting happened.

They say they noticed a man pacing around their car, but never thought it would result in their father fighting for his life.

“I heard the gunshots, and then I saw him leaning over on his console and holding his chest. Then my little brother right here was screaming he’s bleeding,” says the man’s daughter, Alexas Rhinehart.

On Friday, the Colorado Springs Police Department (CSPD) arrested a 24-year-old Zackrey Snell, who is accused of shooting a man in a parking lot. That man is Alexas and Connor’s father.

Alexas and her little brother say they were sitting in their car, waiting to pick up their mother from work.

That’s when a man, whom they do not know, approached the driver’s side and shot their father.

Alexas says she quickly jumped out of the car, leaving her brother and father to get help.

“I immediately had to run out of the car and leave him with dad real quick because I knew he would [be] bleeding out. And I didn’t know how much time left because I didn’t know how many bullet holes he had or how long he had because he was bleeding out bad,” says Rhinehart.

The family tells me, out of fear of returning home, they’ve started a GoFundMe to help with medical bills, but to also relocate to a safer place away from the shooting location, which you can access here.

CSPD says Snell is facing charges for attempted murder, assault in the first degree, prohibited use of weapons, and child abuse.   

He’s being held in jail on a $500,000 bond.

Gauchos come up big even without Little in the lineup

UC SANTA BARBARA, Calif. (KEYT) – Even with point guard Miro Little sidelined with an injury, UCSB pulled off its best win of the season beating Big West leader UC Irvine 84-79 in a home game broadcast nationally on ESPNU.

UConn transfer Aidan Mahaney scored a game-high 21 points while Colin Smith added 17 as UCSB improved to 9-4 in league.

All five Gauchos starters scored in double-figures.

Freshman CJ Shaw scored 15 points and Hosana Kitenge finished with 12 points and 6 rebounds.

The Gauchos outrebounded the Anteaters 37-27 with sophomore Zion Sensley recording a double-double with 10 points and a game-high 13 boards.

The Anteaters dropped to 9-3 in league.

Chopper Fest Rolls into Ventura

VENTURA, Calif. (KEYT) Motorcycle riders rolled into Ventura for the Chopper Fest.

The 22nd Annual David Mann Chopper Fest at the Ventura County Fairgrounds.

The work of late California graphic artist celebrated bike culture.

That is why the chopper fest includes an art show alongside custom motorcycles.

“One of kind year after year after year, there are some here that are 40 years old, there we go and they are works of art,” said Theresa Hanson of Ventura.

Chopper Fest also had live music and lots of businesses on hand selling motorcycle gear, t-shirts and more.

San Marcos girls water polo falls at #1 Mater Dei in CIF Open Division pool play

SANTA ANA, Calif. (KEYT) – San Marcos girls water polo lost at Mater Dei 16-8 as pool play continued in the CIF-Southern Section Open Division playoffs.

Charlotte Raisin scored a team-high 3 goals for San Marcos while Shea Estabrook and Ella Grube each added two goals.

Bethany King made 8 blocks in goal for the Royals.

The top seed Monarchs are now 2-0 in pool play while #5 San Marcos is 1-1.

The Royals will host #8 Long Beach Wilson on Wednesday, February 11th at 5 p.m. to finish up pool play.

A San Marcos win will guarantee them of advancing to the next round.

Columbia man arrested for murder in Saturday night apartment shooting

COLUMBIA, Mo. (KMIZ)

Michael Graham, 66, of Columbia, was arrested for the shooting death of another Columbia man Saturday night, according to a press release from the Columbia Police Department.

Graham is accused of shooting Vasshon Haywood, 48, at the Oak Towers Apartments, an affordable senior living building in Columbia.

Graham was arrested on suspicion of:

Second-degree murder

Armed criminal action

Unlawful use of a weapon

Stealing

Possession of a controlled substance

Tampering with physical evidence

Graham is being held in the Boone County Jail with no bond.

According to Columbia Police Department Lt. Anthony Bowne, police were called to the 700 block of North Garth Avenue near the Oak Towers apartment building around 9:20 p.m. Saturday night for a report of shots fired.

Police found Haywood with gunshot wounds. He was taken to a local hospital and later died from his injuries, according to the release.

Randy Cole, the CEO of Columbia Housing Authority, who oversees the apartment, told ABC 17 News the shooting was limited to a single unit and involved a conflict between two people.

Cole also said Graham is a resident of the apartment, and Haywood is not.

An ABC 17 News reporter on scene saw several CPD vehicles in the area and an ambulance leave the scene with its sirens on Saturday night.

The reporter went back to the scene Sunday afternoon, and several residents said the shooting happened on the second floor.

Santa Barbara Public Library Kicks Off I Love My Library Campaign

has kicked off.

The library encourages the community to share Valentine-themed messages during the first two weeks of February.

The messages will be presented at the library during National Library Week in April.

Messages can be collected at more than 60 businesses, organizations, and schools throughout Santa Barbara.

The recent sold-out screening of documentary “The Librarians” was in partnership with the Santa Barbara International Film Festival where visitors participated in the library campaign.

Americans expected to spend over $20 billion for this year’s Super Bowl, survey shows

Super Bowl 60 is set to kick off Sunday evening, and fans are expected to spend a total of $20.2 billion in preparation, according to a report from the National Retail Federation.

That’s about a $1.6 billion increase from last year, but consumers will see an average $3.19 increase.

The report shows an individual average of $94.77, with 79% of people choosing to buy food and drinks.

Team apparel comes in much lower, with 15% of people, and 11% of people plan to buy TVs, according to the report. Decorations and furniture are the least popular, with 8% of people planning to purchase.

Over 213 million Americans plan to watch the game, and over half are expected to either go to a watch party or throw one, according to the report. About 18.2 million people plan to watch at a bar or restaurant.

Last year, the Kansas City Chiefs faced off against the Philadelphia Eagles in New Orleans for Super Bowl 59 and lost 40-22.

This year, the Super Bowl won’t be as stressful, Columbia resident Kristi Peterson said.

“We’re just going to hang out at home, with the family, watch a little of the game, since it’s a nonstressful game,” Peterson said. “But we’re looking forward to the Super Bowl halftime show.”

Peterson and her young daughter said they are both ready to dance to halftime performer Bad Bunny– a Puerto Rican artist.

The Petersons are among 18% of people who are looking forward to Bad Bunny’s performance, according to the report.

The report shows 43% of people believe the football game is most important, and 18% of people said they’re looking forward to the commercials.

Peterson said she’ll also have a few appetizers to go along with the game, in typical football fashion.

“We’ll have buffalo chicken dip and chips and salsa, and mostly just football food,” she said.
