GoFundMe set up for family of 5-year-old fatally injured while playing on rocks at Rincon Point

Tracy Lehr

VENTURA COUNTY, Calif. (KEYT) – The tragic loss of a young boy on a local beach is raising awareness about coastal rock walls.

It happened before sunset on Sunday over the Labor Day weekend.

A Palmdale family were enjoying the beach at Rincon Point with friends who live in the area.

Around 7 p.m., their son, 5-year-old Maxwell, slipped while climbing the rocks that line the beach with his best friend.

It appears a loose rock above him gave way and fell on top of him causing significant head injuries.

Maxwell died a short time later.

His uncle Daniel Kessler shared a heartfelt message to thank those who responded and those who have already contributed to: https://www.gofundme.com/f/Maxwell-Oliver

The GoFundMe was set up by their family friend Bryan Holloway and will help with memorial and other expenses.

“We would like to extend our heartfelt thanks to all the first responders who desperately, valiantly tried to save little Max’s life, people that gave him aid at the beach to the people who took him to the emergency room, the hospital chaplain there to comfort Mikey and Christine in their hour of need,” said Kessler, “we would just like to ask that everybody; hug their loved ones a little tighter today and tell them you love them.”

Friends would like to see warning signs added near the rocks that line Rincon Point.

The same rock formations line the beach at La Conchita too.

A La Conchita resident recall seeing first responder vehicles, with flashing lights, heading north that night past Carpinteria.

They took him to Cottage Hospital in Santa Barbara.

Maxwell is being remembered as an “energetic spirit with a huge heart” who loved exploring California beaches with his family.

“It gives us hope,” family optimistic with release of new age-progressed image of missing baby

Michael Logerwell

COLORADO SPRINGS, Colo. (KRDO) – On July 15, 1986, seven-month-old Christopher Abeyta went missing from his family’s home in Colorado Springs.

Since then, Colorado Springs Police have made no arrests, and the family hasn’t seen or heard from baby Christopher.

But they’re not giving up hope.

RELATED: New age progression image released for boy abducted out of Colorado Springs

The National Center for Missing & Exploited Children (NCMEC) released this photo last week. It’s an age-progressed image of what a 39-year-old Christopher would look like today.

Over the years, the Abeyta family has had nine aged-up images of Christopher created, trying to keep his disappearance in the public eye in hopes it leads to new tips.

While family members tell KRDO13 Investigates they are confident in the accuracy of this image, they’re not putting all their hope into this one image.

Rather, his youngest sister called it one tool in the toolbox to find him.

Different age-progressed sketches and images of Christopher Abeyta.

“I also do have a concern that people would be just looking for a person that looks like them without looking at there’s going to be circumstances with that person,” Denise Abeyta Alves says they’re not looking for look-a-likes.

“There’s got to be, hey, they don’t have infant pictures of up until seven months old. There are questions about their identity,” Denise Abeyta Alves said. “And then they have to look at Christopher’s case information.”

Denise Abeyta Alves was 15 years old on July 15, 1986, when her baby brother went missing. Details of that night have been burned into her mind. They had family friends over for dinner, her parents’ anniversary had just passed, and baby Christopher had hit some milestones.

“It was the first time he grabbed his hands on the coffee table and raised himself up,” Abeyta Alves reminisced. She added that it was the first night she bottle-fed him and even offered to tend to him that night if he woke up crying, but that didn’t happen.

Instead, after the family went to sleep at 12:30 a.m., something else happened in the middle of the night.

“I heard her [my mother] very loudly. ‘Christopher, he’s not here. Where’s Christopher? He’s not here,” Abeyta Alves remembered the panic from the next morning.

In the passing days, months, and years, Abeyta Alves says the family realized they were being stalked. She remembers receiving consistent hang-up calls late at night to her home and her uncle’s home in Pueblo— even once when a woman showed up at her grandparents’ home looking for family pictures. The woman told them it was for a high school class reunion, which Abeyta Alves says they later learned was never planned.

As of publication, no arrests have been made.

Worth a thousand words

This most recent image of a 39-year-old Christopher Abeyta was created by the National Center for Missing & Exploited Children (NCMEC).

In an NCMEC blog post from February, the organization says a team of four forensic scientists is “responsible for the creation of more than 7,800 age progressions of long-term missing children and more than 300 reconstructions of unidentified deceased children.”

NCMEC says their artists work in Adobe Photoshop and study skull development, analyze family traits and use ancestry clues when creating the aged-up images.

It’s come a long way since the late 1980s, when the Abeyta family was relying on sketch artists.

More information and updates about Christoper Abeyta can be found on the Facebook page run by the family.

Local fosters mentorship & community through Yuma Adult Flag Football League

Danyelle Burke North

YUMA, Ariz. (KYMA, KECY) – A local man is making a difference and bringing mentorship and community through football.

Local dad and mental health advocate Keith Francis was looking for an adult flag football league when he first moved to Yuma. He couldn’t find one, so he made a game plan and started his own.

Francis started the Yuma Adult Flag Football group three years ago, and it hasn’t stopped growing since.

“Now, we have upwards of 80 guys coming out to play with us each season,” said Francis.

Teams of all ages have traveled in state to compete in the league’s cash prize tournaments. All with one common thing.

“The love of football,” said member Armando Mosqueda. “We play and just meet new people and build a community around.”

Mosqueda, a coach for Yuma High School says everyone has become one big family, and it’s great seeing his students join the team alongside him.

“It’s kind of surreal to watch them grow up. Watched them grow up and play for three years, and then now all of a sudden they’re my teammates, and I just get to hang out with them. And it’s like a different kind of camaraderie,” said Mosqueda.

If you want to join, they provide the flags, but just bring your cleats. You can find more on their Facebook and Instagram pages.

County of Monterey sued over harassment, discrimination and retaliation claims by former deputy in the Sheriff’s Office

Jeanette Bent

Disclaimer: There is strong, explicit sexual language quoted from the complaint below. The full court document is embedded at the bottom of this article.

MONTEREY COUNY, Calif. (KION-TV) — The Monterey County Superior Court reported a lawsuit against the County of Monterey Friday, claiming an alleged sexual harassment and discrimination case against a former deputy and a current captain with the Sheriff’s Office.

According to court documents, the plaintiff worked for the County of Monterey since 2014, having held roles within crisis negotiations, search and rescue, defense tactics, first aid, jail operations, recruitment, and the collision committee.

The allegations state that the defendant, retired Sergeant Michael Smith’s, “behavior escalated from unprofessional/inappropriate to blatant, severe sexual harassment and overt gender discrimination,” citing an approximate four-year timeframe (2019 until 2023).

Screenshot from page 5 of the complaint

“Mike would tell plaintiff that she was a ‘whore’ and that it was okay ‘because all women are whores, just some more than others,'” according to the compliant. The compliant states: “Mike routinely objectified and sexualized plaintiff and spoke about her physical appearance on a regular basis.”

Among these, two explicit examples referenced in the court document stated inappropriate comments to the plaintiff as well as attempts to sexually engage with Smith.

In the document, it was stated that the Smith made “fairy dust” jokes referencing the plaintiff’s genitalia, stating that he “told the whole investigations unit that plaintiff has ‘fairy dust coming out of her vagina,’ that ‘her vagina is magical’ and that every man who experiences it seems to be under her magical spell.”

The plaintiff saying that he sent “group messages with ‘tinker bell’ waving a wand that releases fairy dust.”

The second example, as outlined in the court document, refers to a “snake shirt” incident:

“Plaintiff was in court to testify for a case on a Friday, and she wore a grey suit with a grey snake print shirt underneath. On Monday, when plaintiff returned to work, Mike said suggestively, ‘You wore my favorite shirt and you didn’t let me see it.’ Plaintiff responded that she didn’t know what he was talking about, and he said, ‘You know which shirt… The snake shirt.’ Plaintiff was surprised and bothered that Mike knew what she wore to court days before, and asked how he knew. She felt like he was stalking her.”

In addition to this, the court documents reported that not only was the plaintiff being harassed by the Michael Smith, but also his wife Rebecca Smith and a captain at the sheriff’s office. Rebecca Smith is named as the second defendant in this case.

The document outlining multiple alleged instances throughout the four-year period where the husband-wife defendants reportedly harassed, discriminated and retaliated professionally, including throughout the duration of the plaintiff’s two pregnancies.

During one instance, the document outlined an alleged deliberate request from Michael Smith over sexual intercourse:

“Mike cut her off and said, ‘Are we going to fuck after this?’ Plaintiff asked what he meant, he repeated, ‘Are we fucking or not? Because if you aren’t going to fuck me, I really don’t care to know anything about you.’ She asked if he was serious and he responded yes.”

The court documents stating that tensions continued to escalate until the plaintiff claimed that she felt physically unsafe in the presence of Michael Smith.

“Plaintiff was frightened and began to cry,” according to the document. “She was afraid that her partners had left her alone with Mike when he was that angry.”

Screenshot from page 17 of the complaint

In June 2024, Sheriff Nieto’s response to altercations between the Smiths and the plaintiff were met with indifference. She said that after meeting with the Sheriff regarding a locker issue, she decided to relocate, saying that Sheriff Nieto responded with:

“Good because I don’t want to hear any of that drama. I don’t care if someone doesn’t like you or if you don’t like someone, that’s not something I’m going to spend time resolving.”

Screenshot from page 23 of the complaint

These allegations continued throughout 2024, the document stating that the “plaintiff is informed and believes that the MCSO took no actions to investigate her complaints of sexual harassment and retaliation, or to prevent further harassment or retaliation.”

Screenshot from page 24 of the complaint

The plaintiff, claiming that by the time it got to August 2024, she had experienced “severe emotional distress with catastrophic consequences for her mental and physical health. She has been enduring Mike and Rebecca’s torment since 2019, and despite reporting the harassment, discrimination, and retaliation, she knows that MCSO did nothing to stop Mike and Rebecca’s behavior. Respondent did nothing to protect plaintiff from unlawful, severe and pervasive harassment discrimination, and retaliation.”

Screenshot from page 26 of the complaint

Finally, at the beginning of 2025 and after being denied an interview for a new professional position after allegedly being the only candidate, the plaintiff took action against the Monterey County Sheriff’s Office by filing a lawsuit with six claims.

The claims are for sexual harassment; sex discrimination; failure to investigate and prevent harassment and discrimination; intentional infliction of emotional distress; and two counts of retaliation. The plaintiffs attorney is demanding a jury trial, damages, and individual action.

KION has reached out to the Monterey County Sheriff’s Office for comment, but they declined to respond.

Samson Garner, accused of planning mass shooting, takes the stand in his own defense

Claire Elmer

WARNING: This story includes discussion of suicide. Reader and viewer discretion is advised.

(Update: adding video)

BEND, Ore. (KTVZ) — Monday in Bend at the Deschutes County Courthouse, Samson Garner took the stand in his own defense. Garner is accused of planning a mass shooting at Smith Rock in October of 2023.

Garner was questioned by his own legal team, largely about the email he had sent to an ex-girlfriend, in which described his plans to carry out the attack on climbers attending the Smith Rock Craggin’ Classic.

Garner testified at the time he sent the email, he was intoxicated and suicidal. He claimed he had been having intrusive thoughts and nightmares which scared him.

In his testimony, Garner stated: “I remember seeing the email and having this intrusive image come into my head doing this, and it was terrifying…not something I wanted to be thinking. It’s not something I wanted to be — have — in my head.”

“I remember adding it to the email to Penny as just one of the other reasons that I wanted to take my own life. It was like I didn’t want to keep thinking these things. I didn’t want to carry out any of these things. I just would rather kill myself,” claimed Garner.

About a week after sending the email, Garner testified he had an epiphany in which he realized he had a reason to live. He wanted to get outdoors more and go target shooting — which he claimed is why he came to Central Oregon with an AR-15 and magazines.

The defense planned to continue their examination of their client throughout the day on Monday and into Tuesday morning.

Banning man sentenced to 30 years for raping woman, molesting child

Jesus Reyes

BANNING, Calif. (KESQ) – A 43-year-old Banning man was sentenced to 30 years in prison after being convicted of raping a woman, as well as molesting a 12-year-old girl.

A Banning jury in early July convicted Steven Roy McElroy of forcible rape, lewd acts on a minor, assault with intent to commit rape and a sentence-enhancing allegation of targeting multiple victims. He was acquitted of a related charge of rape of an intoxicated person.

During a hearing at the Banning Justice Center Monday afternoon, Riverside County Superior Court Judge Mark Singerton imposed the sentence required under state law for the crimes.

Steven Roy McElroy was arrested in 2022 following an extensive Banning Police Department investigation that relied on statements from alleged victims going back a decade.

McElroy was charged for the alleged assault on the 12-year-old girl in March 2022.

Banning police detectives received information afterward concerning two women who alleged they had been sexually assaulted by him on different occasions in 2015 and 2016.

According to Detective Jack Loera, the two women heard about the child molestation charge and decided to speak to police.

Asked why it took so long for her to make the allegation, one of the women said she didn’t think authorities would take her seriously regarding the alleged rape at the time, so she waited for the other woman to make her allegations before disclosing her own, according to court papers.

The original incident that led to all of the charges occurred on Dec. 26, 2021, according to the brief.

McElroy has a felony conviction in another jurisdiction that wasn’t listed in court documents.
