Men sentenced for role in deadly robbery at Cabazon outlet mall

BANNING, Calif. (KESQ) – A 22-year-old who pleaded guilty to voluntary manslaughter in the shooting death of a 66-year-old man at the Desert Hills Premium Outlets in Cabazon was sentenced to 11 years in state prison.

Elijah Ray Burt, 22, was sentenced Friday at the Banning Justice Center. According to the Riverside County District Attorney’s office, he was credited 1201 days for time served and ordered to pay $3,000 in restitution.

Burt was arrested along with his twin brother, Emanuel Rick Burt, and a third suspect, Reginald Charles Trice, for the slaying of Michael Moser of Palm Springs in March 2022.

Trice pleaded guilty to murder last week. He is scheduled to be sentenced on Oct. 10 at the Riverside Hall of Justice.

Emanuel Burt was convicted in November of conspiracy and was sentenced to six years in prison.

Sheriff’s Sgt. Ben Ramirez alleged Trice confronted Moser shortly before 7 p.m. on March 24, 2022, in the 48600 block of Seminole Drive, though the specific location within the mall wasn’t provided.

Ramirez said Moser was shot at least once, prompting calls to 911, after which deputies and paramedics converged on the location. He was pronounced dead at the scene.

There was no sign of the defendants when deputies reached the mall. However, Ramirez said over the ensuing weeks, detectives developed leads pointing to Trice as one of the alleged assailants. A warrant was obtained and served at his residence in the 15500 block of Morada Road on April 21, 2022, according to the sheriff’s spokesman.   

The defendant was taken into custody without incident.

The brothers were identified and named in the criminal complaint after Trice’s arrest.

They were tracked down and taken into custody in Las Vegas at the end of April 2022. A month later, they were returned to Riverside County.   

None of the men had documented prior felony convictions in Riverside County.

State expert testifies that Jefferson City child murder suspect is competent for trial

JEFFERSON CITY, Mo. (KMIZ)

A state psychologist testified Friday that a woman charged with murdering a 4-year-old boy in Jefferson City in 2018 is mentally competent to go to trial.

Tiffany Harris, a forensic examiner and senior psychologist for the Missouri Department of Mental Health, testified during a hearing in the Cole County Courthouse that Quatavia Givens’ behavior shows she is competent. She has been diagnosed with PTSD, but that does not affect her ability to stand trial, Harris testified.

Givens was deemed mentally incompetent in 2023 and, since then, has yet to stand trial.

Quatavia Givens, 32, was charged with first-degree murder, child abuse, first-degree endangering the welfare of a child and abandoning a corpse in relation to the death of 4-year-old Darnell Gray in 2018. She is listed on the Cole County Jail online roster, but was admitted to Fulton State Hospital last year.

The state argued Friday before Judge William Hickle that Givens understands the legal process and the charges against her. Medication has improved her psychological symptoms, prosecutors claim.

Givens’ defense claims that its experts believe she has not received proper treatment to render her competent for trial. They say Givens needed individual intervention not group classes like “Court Education” and “Seeking Safety” that she is apart of at FSH. The defense also argued that Givens’ PTSD makes it hard for her to confront the details of the case and participate in her defense.

Court documents say that Givens allegedly struck and smothered Gray, resulting in his death.

Hickle said he will consider the arguments before issuing his ruling. A decision is expected early next week.

Former Jefferson City Boys and Girls Club cook charged with child sex crime

The former head cook of the Jefferson City Boys and Girls Club has been charged with a child sex crime in Cole County.

Scott Minor, 45, of Jefferson City was charged on Thursday with child enticement. He is being held at the Cole County Jail without bond. A court date has not been scheduled.

Court documents say Minor tried to entice a 12-year-old, but reference inappropriate conversations he had with other children. Text messages recovered by law enforcement allegedly show Minor admitting to “dating” a 14-year-old. Minor allegedly communicated with children with an app, as well as the website Omegle.

The Pea Ridge, Arkansas, Police Department also allegedly obtained communications between Minor and one of the children.  That information was obtained after the victim’s mother consented to have data from the victim’s cellphone extracted by law enforcement, the statement says.

Court documents say Minor was taken into custody on July 25 for unrelated warrants. Law enforcement asked him about his employment status and he allegedly said he was fired from the Boys and Girls Club on July 20 after they heard about the allegations against him.

The Boys and Girls Club confirmed he is not currently employed with them in an email to ABC 17 News.

“The safety and protection of the young people we serve is—and will always be—our highest priority. We are aware of the arrest of a former staff member involving alleged inappropriate behavior toward a minor. We are deeply disturbed by these reports, as no harm should ever come to any child. While the reports do not involve any Boys & Girls Club members, our thoughts and support are with the victim and their family,” the email says.

A social media post from the Jefferson City Boys and Girls Club indicates he was hired in July 2024.

Court documents say Minor thought he was being interviewed by law enforcement about a separate instance of having inappropriate communications with a youth on Omegle, but claimed he did not know that girl’s age. Omegle is a website where people can video chat with each other.

Minor alleged he did not talk about anything sexual with the 12-year-old, despite law enforcement gathering evidence showing otherwise. He allegedly told law enforcement that by the time the child is 18 years old, he will be older than 50 and “would have probably forgotten about her,” according to the probable cause statement.

Law enforcement gathered more messages from Minor’s electronic devices from May 29-June 25 that show a number of inappropriate conversations between Minor and the youth.

Palm Springs Pride moves forward with 2025 festival despite $325K sponsorship shortfall

PALM SPRINGS, Calif. (KESQ) – The annual Palm Springs Pride celebration will proceed as scheduled, despite a significant shortfall of $325,000 in expected funding, organizers announced on Friday.

Palm Springs Pride 2025 is scheduled to take place Nov. 6-9. The four-day celebration will remain free to attend and is expected to attract over 200,000 people to the Palm Springs area, generating an estimated $35 million in economic impact, organizers said.

Organizers with Greater Palm Springs Pride said they believe the shortfall is a direct result of the current political climate, which has led to a decrease in sponsorships.

“The organization believes the shortfall is a direct result of the current political climate, which has led to a decrease in sponsorships. However, Palm Springs Pride remains driven by its mission of honoring the LGBTQ+ community’s struggle for equality and celebrating its rich history, diversity, and future. Organizers are honoring the struggle and creating a path forward just as members of the LGBTQ+ community have done since the 1969 Stonewall Uprising.”

According to Greater Palm Springs Pride President and mayor, Ron deHarte, some of the loss is connected to one donor who has political ties to the Trump administration. He would not name the donor.

“We’re seeing a lot of our local and, national vendors just cutting back on their marketing dollars this year. But a big vendor, a very large, significant vendor out of Florida, is directly tied to the current administration’s political position,” deHarte said.

He says the funding cuts will likely impact the festival’s entertainment lineup, with the cuts shrinking the festival’s budget from nearly $1.2 million to around $800,000 according to Mayor deHarte.

“I think we’re going to see maybe we won’t have such large stages. Maybe there won’t be such grandiose names on the entertainment lineup, but the festival footprint is going to be the same footprint that we’ve seen for years downtown.”

He also addressed proposals around making the festival ticketed, but said Pride does everything in it’s power to keep the event free.

“We’re the largest festival that’s free south of San Francisco. We committed to that back in 2014 and it’s something that makes Palm Springs unique. It takes away all financial barriers for somebody who wants to come out and participate in pride. So we’re committed to continuing to do everything we can to keep the festival free,” deHarte said.

Planning is underway to ensure the festival and parade remain as meaningful as ever. The commitment to a safe and welcoming environment for all attendees remains a top priority.

Changes with Urchin Boat Docks at the Santa Barbara Harbor May Open Slots

SANTA BARBARA, Calif. – The popular urchin boating industry has had the opportunity to dock in a close location at the Santa Barbara harbor, but that is possibly changing.

A multi-year agreement expired last year but it was extended for another 12 months while the deal was reviewed.

The city says in a report, “since 1987, the north end of the Cabrillo Landing dock area of the Santa Barbara Harbor has been operated by the California Sea Urchin Commission (CSUC), Santa Barbara Chapter, to berth nine commercial fishing vessels under a license agreement with the Waterfront Department. The latest license agreement expired on August 31, 2024, and it is currently in holdover status.”

The Santa Barbara Waterfront Department is now allowing those fishing vessels to stay if the owners enter into a commercial fishing vessel docking agreement like the other boaters in the harbor.

If not, and if they allow their spot to be vacated, the city can allow another commercial fishing vessel in that location under the standard agreement.

The proposal went before the Santa Barbara Ordinance Committee recently and it will get some fine tuning before it goes to the full City Council for a discussion and vote.

If passed, extensive messaging will be going out to the fishing communities that would have an interest in this site and as they open up, one of the nine slips as commercial fishing slips, to be governed under the Commercial Fishing Policy as Slip Permits.

The urchin fishing industry in Santa Barbara is known throughout the world. “Santa Barbara urchins are recognized globally as super high quality. We have really phenomenal grounds at San Miguel, Santa Rosa, Santa Cruz  and Anacapa Island,” said Chris Voss, the President of the Commercial Fishermen of Santa Barbara.

As far as any significant changes going forward, nothing is expected. Voss said, “the current fleet will will continue to fish out of this space, and these are now nine dedicated commercial slips that are added to the existing 45 that we have.”

Picking a new commercial vessel if a slip opens will be done randomly. 

Waterfront Business Manager Cesar Barios told the Ordinance Committee, “if we have new additions today and a new addition in three months from now, the chances will be the same because it will be a lottery so longevity in the process won’t affect the outcome.”

The logistics involved in the slips and where they are located has Voss pointing out, “not all of them are of are of the same quality and characteristics. There’s some real low value slips here.”

The Santa Barbara urchins are in local restaurants but also sought after by chefs many miles away. You can buy them whole or buy a sample Saturday morning’s at the Fisherman’s Market on the harbor pier from 6 a.m. to 11 a.m.

The council will vote on the slip agreement changes Tuesday at Santa Barbara City Hall.

Critical Decision Making is a Focus of Police and Fire Training in Arroyo Grande

ARROYO GRANDE, Calif. – Training exercises for police and fire departments are taking place in various locations in SLO county this week and over the weekend.

Some will continue next week.

In San Luis Obispo, a 20-acre property with 2 homes is in use for a structure fire training opportunity before it faces potential demolition, and that operation will be carried on through next week.

The police departments for Grover Beach, Arroyo Grande and Pismo Beach, plus California State Parks Rangers, Five Cities Fire Authority, and CAL FIRE, are staging training exercises at Calvary Chapel church and other Five Cities locations.

“This is training for critical incidents and responding to them,” says Sgt. Matt Goodman, Grover Beach Police detective and site coordinator. “Typically, the active shooter is what most people know as a critical incident that makes the headlines in the news.”

Calvary Chapel church in Arroyo Grande hosted the event Friday, and the lead pastor proudly served as the cook at lunchtime, praising the work of those in uniform who take the highest of risks every day.

“Our congregation believes deeply in law enforcement and what they do, so when they approached me and asked if they could do some kind of a training, I thought, yes, absolutely,” says Calvary Chapel pastor George Nevarez.

Authorities used press releases, social media and door-knocking to alert neighbors ahead of the training.

“I think it’s good for us to be transparent and share this information,” says Det. Sgt. Goodman. “I think it’s good for knowledge purposes.”

As for the training exercises themselves, a high level of realism is achieved with a combination of role players and tactical training technology.

“We have the ability to utilize equipment from a company called SB Tactical,” says Det. Sgt. Goodman. “The officers wear a vest that has sensors on it. They wear a shock belt and they have special firearms that only emit an IR laser. And the sensors absorb the laser and then it sends a signal to the shock vest and the officer will get that immediate response that they have been shot. You get 50,000 volts and a 10th of a second.”

Friday at Calvary Chapel was focused on piecemeal training and running drills.

Saturday is what they call ’Scenario Day,’ and they’ll be staging real-time active shooter exercises at grover beach elementary school.

These trainings happen every year.

Program instructors say they’re an essential part of preparation for the critical, fast decisions police officers, firefighters and rangers have to make, sometimes in life-or-death situations.

PALM SPRINGS, Calif. (KESQ) – The first weekend of Splash House is set to kick off on Friday with “After Hours” at the Palm Springs Air Museum.

The first weekend of Splash House is sold out, bringing thousands to the Coachella Valley. It’s taking place on Aug. 8-10.

Friday night will see a special set by Diplo and BLOND:ISH, as well as Chicago’s Azzecca.

The popular poolside festival takes place Saturday and Sunday at the Saguaro, Renaissance, and Riviera (formerly Margaritaville) in Palm Springs.

Weekend One highlights include viral hitmaker ACRAZE, SoCal party-starter Disco Lines, genre-bending British icon TroyBoi, tech house groover Westend, techno provocateur Eli Brown, and rising star San Pacho. The weekend continues with high-tempo heat from Brooklyn-based jigitz, Bristol native NOTION, Grammy-nominated producer Wuki, Irish duo 49th & Main, Italian underground favorite Matisa, bass house boss Nostalgix, powerhouse producer Marten Hørger, UK bass slammer ATRIP, and the euphoric stylings from dance-pop favorite Hayden James. The poolside festival will take place during triple-digit heat in the Coachella Valley. Palm Springs broke a 50-year record on Thursday, topping out at 119.

Temperatures are expected to remain over 110 degrees over the weekend.

American Medical Response (AMR) workers spoke with News Channel 3 during last year’s festival about avoiding heat-related illnesses.

Earlier this week, health officials shared a reminder to residents across the county to protect themselves against extreme heat and heat-related illness.

Public steps up to quickly adopt most of a dozen Toy Australian Shepherds surrendered by Tumalo-area owner

TUMALO, Ore. (KTVZ) – The Deschutes County Sheriff’s Office, in partnership with the Humane Society of Central Oregon, said Friday it was seeking to find loving homes for 12 Toy Australian Shepherds surrendered from a Tumalo-area property owner who deputies said will face a felony animal neglect charge.

And within hours of Friday’s announcement, most indeed had found new homes.

Here’s the information shared with KTVZ News in a news release from DCSO Public Information Officer Jason Carr:

Last Sunday, Bend Fire & Rescue responded to a property on Tumalo Reservoir Road for a reported structure fire. While there, firefighters observed multiple dogs living in filthy conditions and requested assistance from the Sheriff’s Office.

Deputy Benn Smith responded to the scene and found the dogs on the property. He discovered extensive accumulations of animal waste inside the home and in the basement.

After speaking with the owner, 38-year-old David De Persio, 12 dogs were voluntarily surrendered and taken to HSCO. De Persio was cited for Animal Neglect in the Second Degree, and the charge is being elevated to a Class C Felony under Oregon law due to more than 11 animals being on scene, Carr said.

The surrendered dogs are generally healthy but under-socialized, meaning they will do best in homes where they can receive extra one-on-one attention, training, and patience. All have received veterinary examinations and age-appropriate vaccinations and will be spayed or neutered before adoption.

The 12 Toy Australian Shepherds are being processed for adoption through the Humane Society of Central Oregon. Anyone interested in providing a home for one of these dogs should visit the shelter at 61170 SE 27th Street in Bend, Oregon, or visit their website www.hsco.org for more information on the adoption process and availability.

Two of the dozen dogs need additional medical attention before they can be adopted. Because of their lack of socialization, many of the dogs are shy around people. Others did not receive proper toilet training. The Humane Society recommends experienced owners look into adopting them.

“They’re going to need a home where somebody is pretty dog savvy. They’re going to need to be patient or need experience with the breed,” said Lynne Ouchida, HSCO’s director of community partnerships.

“Toy Australian Shepherds are not just small, standard Australian Shepherds,” she added. “They do have the personalities of the toy breeds, which is going to be active, needing a lot of enrichment. ”

While adopting and volunteering can be a great way to support the Humane Society, they currently have a critical need for dog treats, and are asking the public to make donations. These dog treats are used in rehabilitation training while canines stay at the shelter.

The Deschutes County Sheriff’s Office thanked Bend Fire & Rescue for reporting the conditions, Deputy Smith for his quick response, and HSCO for their commitment to animal welfare. Community members are encouraged to consider adoption to give these dogs the second chance they deserve.

Air Quality Alert issued for Ventura County Following Canyon Fire

Below is a press release from the Ventura County Air Pollution Control District regarding a Air Quality Alert.

VENTURA, Calif. – The Ventura County Air Pollution Control District is issuing an Air Quality Alert because of unhealthy air quality conditions caused by the Canyon Fire. Impacted areas may include, but are not limited to, Piru, Fillmore and Santa Paula.

Smoke from the Canyon Fire has caused air quality to fall into the unhealthy range for the general population, as measured by the U.S. Environmental Protection Agency Air Quality Index (AQI). Smoke and ash from wildfires contain very small particles — particulate matter with a diameter of 2.5 micrometers or less — that can harm the lungs and heart.

The district sent text messages this morning through the Farmworker Wildfire Smoke Alert System telling those in Piru that the NowCast AQI had reached an Unhealthy for all level.

Conditions deteriorated overnight and in the early morning today when winds switched direction toward Ventura County. This afternoon, Aug 9, onshore winds will return and help to remove smoke from the Santa Clara River Valley.

Smoke from the Gifford Fire in Santa Barbara County will continue to impact background air quality levels across portions of Ventura County.

The district issues Air Quality Alerts when the AQI has reached or is forecast to reach an unhealthy level for all. A lower AQI can affect sensitive groups. This includes children, older adults and people with heart disease or respiratory conditions such as asthma, chronic obstructive pulmonary disease and emphysema.

The alert is in effect until conditions improve.

When air quality reaches an unhealthy level or when you see or smell smoke, Ventura County Public Health and the district recommend that everyone:

Stay indoors as much as possible, preferably in a clean room with an indoor air filtration device where you can avoid cooking or burning candles.

Close all windows and doors that lead outside unless it is extremely hot.

Operate home and car air conditioners in recycle or recirculation mode. Close the fresh air intake and replace dirty filters.

Avoid strenuous outdoor activity. If you must work outside, wear a properly fitted N-95 mask.

Drink plenty of fluids.

A lower range of AQI can affect sensitive groups. This includes children, older adults and people with diabetes or heart or lung conditions.

The very small particles that pose a danger are PM 2.5, particulate matter with a diameter of 2.5 micrometers or less. An AQI forecast for PM 2.5 reflects what is possible for a 24-hour day. At times, air quality is likely to be better or worse than what is indicated for the entire period. Levels of smoke and particles and the areas affected will vary over time. Conditions can change rapidly depending on winds.

For real-time data on air quality, check the AirNow NowCast AQI at airnow.gov or fire.airnow.gov. AirNow uses hourly data from the district’s five monitoring stations throughout the county to provide air quality information for the surrounding regions.
