Paul Flores Files Second Appeal for Murder Conviction in Kristin Smart Case

Alissa Orozco

MONTEREY COUNTY, Calif. – Paul Flores, the man convicted of killing Cal Poly freshmen Kristin Smart back in 1996, has once again filed a appeal to reverse his conviction.

The now 48-year-old was found guilty of the first-degree murder of Kristen Smart in October 2022. A Monterey County jury sentenced him to 25 years to life in prison, saying he “with malice aforethought murder[ed] Kristin Smart” while “engaged in the commission of, or attempting to commit, the crime of rape.”

Flores is appealing his conviction for a second time, arguing his sentence should be reversed or reduced to second-degree murder. Court documents shown Monday claim Flores did not receive a fair and proper trial.

In the appeal, Flores argues Juror 273 should not have been allowed to testify, two additional alleged rape victims of Flores should not have been allowed to testify, and former San Luis Obispo County Deputy District Attorney Chris Peuvrelle committed misconduct during his closing arguments.

Flores’ defense team used the same arguments in his initial appeal two years after his conviction, back in 2024. His team attempted have Juror 273 removed four separate times during the trial for a “dramatic emotional outburst.” The appeal claims Juror 273 admitted to speaking about the case to the bailiff and acquaintances, and revealed her “her jury service in this high-profile case.”

Juror 273 told the SLO Tribune she remained neutral throughout the trial, even after her emotional outburst.

The document criticizes the choice to allow two alledged victims to testify. It claims by allowing the two female witnesses to take the stand, their testimonies contributed to “enabling the prosecutor to argue that appellant had done the same to Smart, though no independent evidence supported this theory.” Flores and his team continue to argue there is no evidence he sexually assaulted Kristin Smart, and Monterey County Superior Court Judge Jennifer O’Keefe abused her authority by letting the two women testify.

“Even under the relatively low probable cause standard used at a preliminary hearing, the non-character evidence failed to establish that appellant killed Smart in the commission of an actual or attempted rape of any type.”

The testimony of Trevor Boelter was also criticized after saying in court Smart appeared ‘roofied’ the night of her disappearance. Flores’ team claims this lacked adequate foundation and was merely hearsay he read about in a newspaper article.

“There was no evidence he saw his drink being spiked, heard about it after the fact, or saw otherpeople spiking drinks with roofies that same night. Quite conversely, Boelter denied that he “saw drugs around” on the night in question.”

Flores is currently serving his sentence at Corcoran State Prison where he was moved to after being attacked twice at Pleasant Valley State Prison in Coalinga.

An appeal date for oral arguments has not been set as of Wednesday morning.

Internal investigation into Deschutes County sheriff’s Captain William Bailey underway over radio interview

Isabella Warren

(Update: Adding details, video)

BEND, Ore. (KTVZ)– Just weeks before embattled Deschutes County Sheriff Kent van der Kamp retires from his position, an internal investigation has been started against his former political opponent, Captain William Bailey.

An anonymous tip to KTVZ News earlier this month claimed Bailey was under internal investigation over comments made on a local radio show. A third party is now investigating.

Van der Kamp confirmed to KTVZ News on Wednesday that Bailey is under internal investigation for violating policy after discussing the sheriff on La Pine radio station KNCP, though the sheriff said he has not personally listened to the interview and could not provide many details, due to the ongoing investigation.

According to Oregon Public Broadcasting, Bailey spoke on the Muddtoe Radio Show about the sheriff’s failure to continue campaign promises and also alleged he was demoted following his loss.

Van der Kamp did confirm that Bailey’s administrative roles had been stripped as a result, which Undersheriff Aaron Wells has now taken on.

Captain Bailey said he was unable to comment on the investigation, as it is still ongoing.

Bailey was van der Kamp’s political opponent during his last year’s contentious run for sheriff. Bailey was endorsed at the time by departing Sheriff Shane Nelson, who had publicly denounced van der Kamp during the election. Bailey was mentioned in a tort claim filed by van der Kamp against the sheriff’s office, alleging political interference, harassment and targeting.

Sheriff van der Kamp confirmed earlier that his last day in office is July 31st, as he retires following public and internal pressure to step down after local and state leaders found the sheriff untrustworthy. District Attorney Steve Gunnels had earlier this year placed van der Kamp on the Brady List of those officers who are not to be called to testify at trial, claiming he lied about his educational background during previous cases.

Workers at Columbia Starbucks location unionize

Ryan Shiner

COLUMBIA, Mo. (KMIZ)

Workers at a south Columbia Starbucks have unionized.

Employees at the Starbucks at Nifong Boulevard and Buttonwood Drive voted 12-4 on Tuesday to join Starbucks Workers United, according to a Wednesday press release from the union.

The location is the 15th store in Missouri and the first in Columbia to unionize, joining more than 11,000 employees in 45 states and Washington D.C.

“I’m excited to join Starbucks Workers United to encourage change within the company, and hopefully beyond. Given the current political landscape of the country, I think anything we can do to give more power to the workers is worth fighting for. Fighting for better wages and staffing is not only beneficial to partners within the company, but also the customers who pay for quality beverages,” shift supervisor Devin Duffie said in the release.

Starbucks issued a response in an email to ABC 17 News.

“At Starbucks, our success starts and ends with our partners (employees). We respect our partners right to choose, through a fair and democratic process, to be represented by a union or not to be represented by a union, and will continue to work to make Starbucks the best job in retail,” the email says. “Since last April 2024, Starbucks and Workers United have held more than nine bargaining sessions over 20 days and three mediation sessions over five days with a federal mediator. We’ve reached over thirty (30) meaningful agreements on hundreds of topics Workers United delegates told us were important to them.”

Kingdom Coffee Roasting Co. to open new location in St. Joseph

Cameron Montemayor

ST. JOSEPH, MO (News-Press NOW) — Coffee lovers will notice a new aroma emanating from north St. Joseph this year, potentially just in time for pumpkin spice season this fall.

Kingdom Coffee Roasting Co. announced it will make the move to St. Joseph with a new location at 4797 Siena Lane, next to HOTWORX and adjacent to the Shoppes at North Village.

“We’re really excited. We’ve got about 2,000 square feet of space,” owner Ken Burnett said. “We just started construction maybe two weeks ago on the inside.”

If all goes well, the hope is for the new business to be open this fall, potentially as early as September, the latest addition for the fast-growing Tuscany Village area.

Burnett and his wife started the business three years ago and are eager to bring their popular blend of hand-crafted coffee drinks and cafe food items to St. Joseph, their third location including Cameron, Missouri, and Chillicothe, Missouri.

Both of those locations have strong reviews on Google from more than 500 customers, including cumulative ratings of 4.9 out of 5 for both stores.

“I always tell people we’re more of a cafe that specializes in coffee,” Burnett said. “We have a large food menu that has breakfast, lunch and dinner. From fresh salads to homemade cream cheeses for bagels to wraps for lunch to even little breakfast tacos.”

The drink menu features a variety of non-coffee beverages such as fresh-made lemonade, teas and other frozen drinks.

Ownership of a large-scale roasting facility allows Kingdom Coffee Roasting Co. to produce their own fresh beans each week from Arabica coffee grown in Brazil, beans that can be used for their stores or sold to other coffee shops.

“We want to be consistent. We buy high quality equipment for our espresso and our food. We use high quality ingredients for everything,” he said.

The business will include a drive thru — expected to be one of the largest in St. Joseph — and will be open seven days a week from 6 a.m. to 6 p.m.

Burnett said Kingdom Coffee Roasting Co. prides itself on preparing high-quality food and beverages, but just as important is creating a welcoming and encouraging environment for customers and staff as a faith-based business. A portion of every purchase goes towards supporting local charities.

“We just wanted to create a space where anybody is welcome and they just feel like it’s a neighborhood place where we get to know your name, get to know who you are,” Burnett said. “And creating a culture where people want to work … we’re not here to push anything on anyone.”

With years of prior experience in the restaurant industry, including opening St. Joseph’s Texas Roadhouse and corporate experience with Dunkin Donuts, Burnett said the business is focused on providing high-quality training and customer service, comparable to popular restaurants like Chic-Fil-A.

The business is always looking for opportunities to incorporate new menu items by popular demand when feasible, such as a “dirty” Dr. Pepper, a new fad that combines the soda with coconut syrup and a splash of lime juice.

Burnett said one of the biggest upgrades with the new location is the amount of kitchen space to store product and ingredients.

“This location will be a lot more modern with earthy tones to it,” he said. “St. Joe’s a hub for all the smaller towns and communities that surround it … we decided let’s do it because this is the place to be.”

Desert Hot Springs has high hopes for new Desert Community Animal Center

Kendall Flynn

DESERT HOT SPRINGS, Calif. (KESQ) – The City of Desert Hot Springs in partnership with the Greater Palm Springs Animal Allies is opening its new Desert Community Animal Center Wednesday for all residents.

The City has not had a veterinary clinic since 2018, and pet owners had to travel far distances in a time or need or emergencies. Longtime resident Peter Carlson said this has been difficult to do, and he’s been waiting for a local clinic.

“We’ve not really had anything here, we’ve had to go to Thousand Palms, Palm Springs [and] Beaumont,” Carlson said. “We know we can come here and get the care for our family members. They kind of really are for us, so it’s about time.”

The animal center will provide low-cost services to all guests, which the Greater Palm Springs Animal Allies Executive Director Dan Rossi said was an important aspect of bringing it to the local community.

“Our services will be affordable,” Rossi said. “They’ll be on a sliding scale to help anybody depending on their income level.”

Desert Hot Springs Mayor Scott Matas said it will fill the needs of everyone in the community, including his own as a pet owner. Officials are unsure of how many animals they’re expecting to see at the facility, but they do anticipate being busy.

Matas also hopes the center will help with the City’s greater need for upgrades for its Animal Care and Control services. Desert Hot Springs announced this week on social media it will be slowly making changes to the care and control programs by creating a new strategy for pet adoptions.

While the animal center is not directly affiliated with either of the City’s Animal Care and Control facilities, officials hope the low-cost spay and neuter services will help reduce stray population and overall aiding the shelters cause.

“When it comes to your animals, just make sure that they’re spayed and neutered – they’re chipped” Mayor Matas said. “You have those opportunities here in Desert Hot Springs now to get that done at a very low cost rate that helps us control the population.”

DHS residents agree with this sentiment and hope it will also influence people to adopt pets from their local sanctuaries.

“Hopefully with this facility here and our animal shelter here, people will know that they have a place to bring a rescue,” Carlson said. “I think that knowing there’s a facility right next door that they can bring whatever animal they adopted, maybe they’re more likely to adopt.”

Cathedral City officials seized fewer illegal Fourth of July fireworks than ever before

Tori King

CATHEDRAL CITY, Calif. (KESQ)– Have you ever wondered what happens to all of the illegal fireworks that are confiscated by Police Departments on the Fourth of July?

According to Cathedral City Fire and EMS, they are collected by the Cathedral City Police Department and dropped off at Fire Station #2.

“Once the fireworks are seized from the homeowners, we transport them to the fire department,” said Nathaniel Hanley, a Police Commander with CCPD. “Because they have a safer place to store them than here at the police department, and they are more familiar with explosives and anything that can be flammable or spark a fire.”

From there, they are stored inside a safe room until CalFire is able to send a team to pick them up and destroy them.

This year, the pile of seized fireworks was the smallest its ever been.

“When I came in on Monday and looked at this, I was like, is this it,” Cathedral City Fire and EMS Chief Michael Contreras. “Because in previous years we had a lot more than this. And so it’s a good thing we had so little, it really means people are listening to the laws.” In year’s past, the amount of fireworks confiscated would fill several truck loads. This year, the tiny pile of mortars, sparklers, and fountains only fit inside a small trunk.

Officials, including Chief Contreras, believe the city’s aggressive and extensive marketing blitz all over town may have helped spread awareness of illegal firework prevention, as well as the consequences if caught with them in your possession.

“Our campaign that we put out on the bus stops, on the side of all Cathedral City vehicles, that completely focus on safety, it really paid off this year,” said Contreras. “Just says a lot to who we are as a city. We really focus on the safety of our people, and this is just an extension of that. We were successful this year, we’re probably going to have to step it up next year so that we continue to build a safe community.”

City leaders also credit the community with this year’s success, adding that residents made smart choices that kept their neighbors accountable, and their neighborhoods safe.

“In years past, we’ve had houses catch on fire, yards and trees catch on fire, and structures,” said Hanley. “This year we had none of that. So we’re extremely thankful to our community for listening.”

Celeste Springer

PUEBLO, Colo. (KRDO) — The very first Colorado Bojangles opened in Pueblo on Tuesday.

The fried chicken stop calls it a big step towards a larger expansion into the western United States.

“We couldn’t be more thrilled to bring Bojangles to the Pueblo community and introduce our bold Southern flavors to both local community members, visitors and travelers,” said Lissette Amiel, the location’s owner and operator. “We’re proud to serve our delicious chicken, biscuits and tea in this convenient location, and we look forward to creating new jobs and becoming a valued part of the area.”

The new location is at 1275 Drew Dix Parkway, inside the TravelCenters of America. The restaurant chain hopes the location will cater to travelers and tourists looking to get a quick bite in Pueblo.

The chain is primarily found in the south, with the largest number of locations in North Carolina, South Carolina, and Georgia. With exception of only one restaurant in Las Vegas, the new Pueblo location marks the westernmost location for the company.
